Claiming For Car Accident Claim For Compensation Or Not?

As we all think that we are great drivers a car accident will never happen to us! Unfortunately very often it does not boil down to how good or bad a driver we are when the unexpected happens on the road. Here are some tips and things that you need to do whether or not you or any passengers are injured or not or whether it was your fault or not or whether you wish to make a car accident claim for compensation or not. These tips and things that you will need to do apply in all jurisdictions and in all circumstances. Keep this article in the glove compartment of your car. I hope you will not need it!

Some Steps To Check After A Car Accident When Considering A Claim

  1. The very first thing you need to do is to stay put. Do not in any circumstances drive off. Driving off, even if it is your fault or not, is the worst possible thing to do as you will not be able to complete the net seven things on this list and if it was not your fault you will find it very difficult to make a car accident claim for compensation if you were injured.
  2. Check on the health of yourself and if any, your passengers. Then do exactly the same for the driver and if any passengers of the vehicle that you have just tangled with. Should medical attention be needed for anyone then an ambulance can be called.
  3. The net thing to do is to call the police. This is mandatory in some jurisdictions and even if it is not you should still do it. It does not necessarily mean that they will come to the scene of the road traffic accident it will depend on their work load. Certainly in circumstances where the other driver is at fault their report may well be critical back up if you want to make a car accident claim for injuries.
  4. The exchange of information between the two drivers is vital for the repair of the vehicles or indeed the replacement if they are right offs. What are needed by both sides are the insurance details (The name and address of the Insurance Company, the policy number, the start date and the end date of the policy). The make and model and registration number of the other car. The name and address of the other driver also needs to be noted. If the other vehicle is registered abroad than there may well be other information and details to be exchanged. For example a French registered car will need a “constat” to be filled out which are all the details as described before and a diagram of the accident showing the position of the two vehicles. The document needs to be signed by both drivers.
  5. If there are witnesses to the road traffic accident please take down their names, addresses and telephone numbers. If possible try and get a statement off them then and there as it will be invaluable in your car accident claim. If a statement taken on the spot is not possible they should be contacted at a later date.
  6. As soon as you can you should inform your Insurance company of the accident whether or not you were at fault or not. The details from paragraphs 4 and 5 above should also be given to them.
  7. You will need to keep track of your medical treatment and in particular when it happened, with who and the outcome.
  8. Lastly you will need to take some photographs of the accident scene. Remember that nearly all mobile telephones today have a good digital camera! You will find them more than useful in your car accident claim.
